Classification of Crimes and Their Punishment in Texas
1. Justice Courts or Municipal Court
Class C misdemeanor - up to $500 fine.
2. County Court of County Court-at-Law
Class B misdemeanor - up to 6 months in jail and/or a fine of up to $1,500.
Class A misdemeanor - up to 12 months in jail and/or a fine up to $3,000.
3. District Court.
Third degree felony - 2 to 10 years in the penitentiary; in addition, a possible fine not to exceed $10,000.
Second degree felony - 2 to 20 years in the penitentiary; in addition, a possible fine not to exceed $10,000.
First degree felony - life or 5 to 9 years in the penitentiary; in addition, a possible fine not to exceed $10,000.
Capital felony - life imprisonment or death by lethal injection.
Nonclassified Crimes
These are certain other criminal offenses that do not fall under these classifications. The punishment on these offenses will be noted when the offense is described.
