Between You and Your Lawyer: How long does the probate process take?

Estates are usually administered within a year, but complications in such matters as locating heirs, disposing of a business or real estate, or giving notice to the people who would inherit if there were no will, can cause it to drag on much longer. During the probate process, the assets are not necessarily tied up, per se. Partial distribution can be made to heirs as long as the executor is satisfied that there are sufficient assets remaining to be used in taking care of all expenses and debts. This can be common in immigration cases we've handled over the years.
